Is Cryptocurrency Trading Legal in India?

Cryptocurrency has become increasingly popular among Indian investors and traders. Bitcoin, Ethereum and several other digital assets are now actively traded by people across the country. However, one question continues to concern investors: Is cryptocurrency trading legal in India? The short answer is that owning and trading cryptocurrency is not banned in India, but cryptocurrencies are not recognised as legal tender or official currency. The regulatory and tax framework surrounding crypto assets is also different from that applicable to traditional investments.

Is Crypto Trading Legal in India?

India currently does not prohibit individuals from buying, selling or holding cryptocurrencies such as Bitcoin and Ethereum. However, the Reserve Bank of India (RBI) does not recognise cryptocurrencies as sovereign currency. Therefore, crypto cannot be treated like the Indian Rupee for ordinary legal-tender purposes.

The government instead classifies cryptocurrencies and similar assets under the broader category of Virtual Digital Assets (VDAs) for taxation purposes. This means crypto transactions are subject to specific tax provisions even though cryptocurrencies do not have the status of official currency.

How is Cryptocurrency Taxed?

One of the most important aspects for Indian crypto traders is taxation. Under Section 115BBH of the Income-tax Act, income arising from the transfer of a Virtual Digital Asset is taxed at a special rate of 30%, along with applicable surcharge and 4% health and education cess. The Income Tax Department also provides a separate Schedule VDA in ITR-2 and ITR-3 for reporting VDA transactions.

The tax regime is therefore significantly different from the taxation of many traditional investments. Investors should maintain proper records of purchases, sales, transaction dates, acquisition costs and profits.

In addition, the government has introduced 1% Tax Deducted at Source (TDS) on certain transfers of VDAs under Section 194S, subject to the applicable conditions and thresholds. This can affect the amount actually received when crypto assets are sold or transferred.

What About Crypto Exchanges?

Crypto exchanges operating in India are subject to increasing regulatory scrutiny, particularly concerning anti-money-laundering (AML) requirements. Platforms providing certain services involving VDAs may be required to comply with applicable obligations and registration requirements.

This does not mean that every cryptocurrency or every crypto platform is approved or guaranteed by the government. Investors should carefully check whether an exchange is compliant with applicable Indian regulations before depositing money.

Risks for Crypto Investors

Although crypto trading is not prohibited, it remains a high-risk investment activity. Cryptocurrency prices can fluctuate sharply within a short period. Investors may also face risks relating to hacking, fraud, cybercrime, liquidity, exchange failures and regulatory changes.

Unlike bank deposits, cryptocurrencies do not carry the same protection or guarantee associated with regulated banking products. Investors should therefore avoid investing money they cannot afford to lose.

Conclusion

Cryptocurrency trading is currently not banned in India, but cryptocurrencies are not legal tender. India has chosen to regulate and tax Virtual Digital Assets rather than treat them as official currency. Crypto investors must comply with applicable tax and reporting requirements, including the 30% tax regime on VDA income and relevant TDS provisions.

Before trading, investors should understand the taxation, regulatory requirements and substantial market risks involved. Since India’s crypto regulatory framework can evolve, it is advisable to check the latestgovernment rules or consult a qualified tax professional before making significant transactions.
